Children's Privacy Policy

Murmur is committed to protecting the privacy of all users, including children. This policy explains our approach to children's privacy and describes why Murmur is not intended for use by children.
1. Murmur Is Not Intended for Children
Murmur is not directed to, marketed to, or designed for children. You must be at least 18 years old to create an account and use the Service, or the age of legal majority in your jurisdiction if that is higher. Under the Digital Personal Data Protection Act, 2023 (DPDP Act), anyone who has not completed 18 years is a child. This is the minimum age for users in India regardless of any lower age of digital consent that other laws set. We do not knowingly allow children to register for or use Murmur.
Strict Prohibition on Under-18 Communication and Chatting: Murmur does not allow any individual under the age of 18 to chat, message, exchange audio or text, or communicate with anyone else on the platform. Any social or messaging features are strictly restricted to verified adults aged 18 and older. Any account discovered to belong to an individual under 18 attempting to communicate or chat with others will be immediately terminated.
2. Minimum Age Requirement
By creating a Murmur account, you represent and confirm that you meet the applicable minimum age requirement described above. If we become aware that an account has been created by someone who does not meet this requirement, we will take steps to disable the account and delete associated data, consistent with Section 4 below.
3. COPPA Considerations
Murmur is not designed for use by children under 13 years of age and does not knowingly collect personal information from children under 13, as defined under the U.S. Children's Online Privacy Protection Act (COPPA). We do not knowingly permit children under this age to create accounts, record voice memories, or otherwise submit personal information through the Service.
If we become aware that we have inadvertently collected personal information from a child under 13 without appropriate parental consent, we will take steps to promptly delete that information from our systems.
4. What Happens If We Learn a Child Has Used Murmur
If we discover, or are notified, that a user does not meet the minimum age requirement described in this policy, we will:
- Disable the associated account
- Delete personal information, recordings, transcripts, and other data associated with that account, consistent with our Data Retention and Deletion Policy (subject to the limited retention of logs and related data that the DPDP Rules require for at least one year)
- Take reasonable steps to prevent further use of the Service by that account
5. Children and the DPDP Act
The DPDP Act and Rule 10 of the DPDP Rules require verifiable parental consent before a child's personal data is processed, including due diligence that the person giving consent is an identifiable adult. The Act also prohibits tracking or behavioural monitoring of children, targeted advertising directed at children, and any processing likely to harm a child's well-being. Murmur has not built a parental consent process, so it does not permit children to use the Service. We do not track or behaviourally monitor children or direct advertising at them.
6. Parents and Guardians
If you are a parent or guardian and believe your child has created a Murmur account or provided personal information to us in violation of this policy, please contact us using the information below so that we can investigate and take appropriate action.
We will respond to your report within a reasonable period, and in any event within 90 days.
7. Persons With a Lawful Guardian
Under Rule 11 of the DPDP Rules, processing the personal data of a person with a disability who has a lawful guardian requires the verifiable consent of that guardian, who must be appointed by a court, a designated authority, or a local level committee. Murmur requires users to have the legal capacity to accept our Terms of Service and does not currently support accounts managed by a guardian. 8. Changes to This Policy
We may update this Children's Privacy Policy from time to time. We will notify users of material changes through the app or other reasonable means.
