These Terms of Service ("Terms") govern your use of the Murmur mobile application and related services (the "Service"), provided by Murmur ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. Acceptance of Terms
By accessing or using Murmur, you confirm that you are at least 18 years old, or the age of legal majority in your jurisdiction, and that you have the legal capacity to enter into these Terms. If you use the Service on behalf of an organization, you confirm that you have authority to bind that organization to these Terms.
2. Account Responsibility
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
- You must notify us promptly of any unauthorized use of your account.
- You agree to provide accurate information when creating your account, including through Firebase Authentication and Google Sign-In.
3. User Content Ownership
You retain ownership of the voice recordings, transcripts, titles, and other content you create using Murmur ("User Content"). By using the Service, you grant us a limited, non-exclusive license to store, process, and transmit your User Content solely for the purpose of providing and improving the Service, including AI processing described in our AI Transparency Policy.
We do not claim ownership over your User Content. We do not use your User Content to train AI models unless explicitly disclosed and consented to separately.
4. Acceptable Use
You agree not to use Murmur to:
- Upload or generate unlawful, defamatory, harassing, or abusive content
- Violate the intellectual property or privacy rights of others
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the Service's operation
- Use the Service for any purpose prohibited by applicable law

5. AI Limitations
Murmur uses artificial intelligence to generate transcripts, titles, and search embeddings from your voice recordings. AI-generated content may contain errors, omissions, or inaccuracies. Transcription accuracy may vary depending on audio quality, accents, background noise, and language. You should not rely on AI-generated outputs as a substitute for professional advice or as an authoritative record without independent verification. 6. Service Availability
We aim to keep Murmur available and reliable, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, technical issues, third-party service disruptions, or circumstances beyond our control. We are not liable for any loss resulting from such interruptions.
7. Subscriptions and Payments
Murmur currently does not offer paid subscriptions. If we introduce premium plans, auto-renewing subscriptions, or free trials in the future, additional terms will apply and will be presented to you prior to purchase.
8. Termination
We may suspend or terminate your access to the Service if you violate these Terms, engage in prohibited conduct, or if required by law. You may terminate your account at any time by requesting account deletion. See our Data Retention and Deletion Policy for what happens to your data upon termination.
9. Disclaimers and Limitation of Liability
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the maximum extent permitted by applicable law, Murmur and its officers, employees, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or goodwill, arising from your use of or inability to use the Service.
Nothing in these Terms limits any liability that cannot be limited under applicable law, including certain consumer protection laws in your jurisdiction.
10. Indemnification
You agree to indemnify and hold harmless Murmur and its affiliates from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Service.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles, unless otherwise required by mandatory consumer protection laws applicable in your jurisdiction of residence.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes through the app or other reasonable means. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
